Unsecured Loans are Permitted in EB-5
The results of the Zhang case 1 established unsecured loans as a lawful source of funds. More recently in the 2022 EB-5 Reform and Integrity Act, unsecured loans are permitted so long as a lawful source of funds are provided by a lender that is not defined as a bank. Unity Lender provides lawful source of funds on all unsecured loan proceeds to investors to be compliant with USCIS regulations.
